Terms & Conditions

These General Terms and Conditions apply to all orders, purchases, and agreements made through La Gentile. By placing an order on our website, the customer agrees to these terms.

All rights, obligations, and agreements governed by these Terms are subject to Dutch law. Any disputes will fall under the jurisdiction of the competent courts in The Netherlands.

In case of translation or interpretation differences, the English version of these Terms and Conditions shall prevail.


1. General

These Terms and Conditions apply to all sales and agreements between La Gentile and the consumer unless otherwise agreed in writing.

By placing an order on www.la-gentile.com, the consumer confirms that they:

  • have read these Terms and Conditions

  • agree to these Terms and Conditions

  • are legally capable of entering into a binding agreement

La Gentile reserves the right to update or modify these Terms and Conditions at any time.


2. Orders

Once an order has been placed, the customer will receive an order confirmation email containing the order details and total costs.

La Gentile strives to keep product availability on the website as accurate as possible. However, if a product becomes unavailable after an order has been placed, the customer will be informed as soon as possible.

According to EU consumer law, products must be delivered within 30 days after the order has been placed, unless otherwise agreed.

If La Gentile is unable to deliver within this period, the customer has the right to cancel the order.


3. Prices & Payment

All prices listed on the website:

  • are displayed in Euro (€)

  • include VAT (Value Added Tax) unless stated otherwise

Available payment methods may include:

  • iDEAL

  • PayPal

  • Klarna

  • other payment methods offered during checkout

Orders will be processed once payment has been successfully received.

Shipping costs will be clearly displayed during checkout and added to the total order amount.


4. Shipping & Delivery

All orders are shipped with GLS, DHL, or PostNL, depending on the destination.

All shipments include tracking and are insured where applicable.

Processing Time

  • Orders placed before 12:00 (Monday–Friday) are usually shipped the same day.

  • Orders placed after 12:00, on weekends, or public holidays will be processed on the next business day.

Delivery times are estimates only and may vary depending on the shipping carrier or customs processing.

These delivery estimates do not apply to furniture orders.

International Shipping (Outside EU)

International shipments may be subject to:

  • import duties

  • taxes

  • customs fees

These charges are the responsibility of the customer and are determined by the customs authorities of the destination country.


5. Delivery Outside the EU

All packages shipped outside Europe are insured during transit.

In the event of lost or damaged packages, the following applies:

Missing Packages

  • La Gentile is not responsible for missing shipments outside the EU.

  • Refunds can only be issued if reimbursement is received from the shipping insurance.

  • During the investigation period, refunds or replacements cannot be issued.

Damaged Packages

  • Damage caused during transportation is the responsibility of the carrier.

  • Compensation or refunds can only be issued once the insurance claim has been approved.


6. Furniture Delivery (Drop-Shipping)

Certain furniture brands including:

  • Charlie Crane

  • Bermbach Handcrafted

  • Moonboon

are sold under drop-shipping conditions and shipped directly from the manufacturer.

Processing Time

Furniture orders require 1–2 weeks processing time before shipment.

Cancellation Policy

Furniture orders may only be cancelled within 48 hours after placing the order.
After this period cancellation is no longer possible.

Returns

Returns for drop-shipped furniture are not accepted.

However, product defects or complaints will be handled appropriately unless the issue was caused during transportation.


7. Transfer of Ownership

Ownership of the purchased goods remains with La Gentile until the customer has fulfilled all payment obligations.

Ownership and risk transfer to the customer at the moment the goods are delivered.


8. Returns & Refund Policy

Consumers have the right to cancel their order within 14 days after receiving the product, without giving a reason.

After cancellation, the customer has another 14 days to return the product.

Products must be returned:

  • unused

  • in original condition

  • in original packaging

If the return conditions are met, La Gentile will process the refund within 14 days after receiving the returned goods.

Refunds will be issued using the original payment method.

Promotional & Sale Items

Items purchased during promotions or sales:

  • may be returned within 14 days after delivery

Items discounted 50% or more may only be returned for store credit (minus €5 handling fee).

Return Procedure

All returns must include the completed return form included with the order.

Returns without the return form may be refused and returned to the customer.

Shipping Costs for Returns

If an order originally qualified for free shipping, but the order value drops below the free shipping threshold due to a return, the standard shipping cost may be deducted from the refund.

10. Privacy

La Gentile treats customer data with the utmost care.

Personal data collected during the order process is used solely for:

  • order processing

  • payment processing

  • delivery of products

Customer information will not be shared with third parties, except where required for payment processing or delivery services.

Website analytics may collect anonymous data to improve the website experience.


11. Liability

La Gentile strives to ensure that all products and information on the website are accurate and carefully presented.

However:

  • La Gentile cannot be held responsible for damages caused by misuse of products.

  • Product colours may vary due to screen settings.

  • Typographical errors or pricing errors may occur and may be corrected without liability.

La Gentile is not responsible for the content of external websites linked from our website.


12. Force Majeure

In cases of force majeure (events beyond reasonable control such as natural disasters, strikes, or technical failures), La Gentile reserves the right to:

  • suspend obligations, or

  • cancel the purchase agreement without liability.

Customers will be informed in writing if such circumstances occur.


13. Intellectual Property & Copyright

All content on the La Gentile website, including text, images, graphics, and design, is protected by copyright.

It is prohibited to copy, reproduce, distribute, or use any content from the website without prior written permission from La Gentile.
